POLICING

1. “That Conference demands:

a) that the current instructions regarding the deployment of stinger vehicle devices be reviewed.

b) that every vehicle should be equipped with a stinger device, and

c) that members be fully trained in the use of the stinger”.

12. “That the State be deemed to be our employer for the purposes of the transfer of parental leave”.

13. “That the current civil service regulations governing work sharing be extended to members of An Garda Síochána to allow members of An Garda Síochána to job share at a rate of more than 50% of full time pay”.

TRANSPORT

14. That Conference

a) condemns the failure of Government to provide funds for the maintenance of the Garda fleet to agreed standards – 4/5 star NCAP safety rated, saloon cars, and

b) condemns the unacceptable depletion of the Garda transport fleet that has taken place since 2008 and calls on Government to restore it to 2008 levels.

c) highlights the false economy of spending exorbitant amounts of money repairing and maintaining the aging Garda fleet”. Divisions 12 Tipperary, 25 DMR East and 31 Kilkenny/Carlow

15. That Conference calls on Government to have

a) all Garda vehicles exempted from vehicle registration tax and VAT in order to reflect the true cost of Garda transport and

b) the cost of purchase of the Ministerial fleet removed from the Garda vote”.

23. “That the Association demands that the moratorium on the promotion of Gardaí to the rank of Sergeant be removed”.

25.“That Conference demands that a dedicated immigration unit be assigned to each district which covers a regional airport”.

26. “That Conference calls on the Commissioner to ensure that where inadequate fitness training facilities exist that alternate arrangements for gym membership be provided”.

27. “That this Association devises an agreed national strategic plan of action to be activated in the event of a major industrial relations situation developing in the future following a ballotof our members”.

28. “That Conference demands that Garda Management maintains the integrity and professional reputation of the Garda Technical Bureau by continuing to invest in appropriate specialist forensic training”.

29. “That Conference demands that there be no more high speed pursuits by drivers of official vehicles until the regulations for the pursuit of offending vehicles are changed”.

30. “That Conference seeks that family liaison officers are provided with appropriate resources to carry out their duties”.

TRANSFERS

31. “That Conference directs the Central Executive Committee

a) to obtain assurances from the Commissioner that the current economic circumstances will be taken into account in respect of the transfer policy, and

b) that the Commissioner acknowledges that the policy of prohibiting members from serving in their native division has caused undue hardship and discriminated against members seeking transfers”.

CHANGE MANAGEMENT

32. “That Garda Management is obliged to immediately inform members directly when they are cleared of investigation under the Garda Siochana Ombudsman Commission (GSOC); unlike current practice”.

Part II

RULE 3Q –OBJECTIVES

Amendment

In line four after the words “through the” delete the words “Executive of the”.

In line four after the word “Central” insert the word “Executive” and continue

In Line seven after the words “by the” insert the word “Central” and continue

In line eight after the words “next Annual” delete the word “General” and replace with the word “Delegate”

In line nine after the words “notified by the” insert the word “Central” and continue with the remainder of the Rule.

Proposed Amended Rule 3Q will then read:

For the purposes of promoting the objectives and making them effective, the Association may enter into affiliation or agreement with other organisations through the Central Executive Committee, provided always that such affiliations or agreement shall, if proposed at the Annual Delegate Conference be thereat approved or have entered into by the Central Executive Committee shall at the next Annual Delegate Conference be notified by the Central Executive Committee for ratification.

RULE 25 – TELLERS

Amendment

In line one delete the words “The Conference Arrangements Committee” and replace with the word “Conference” and continue.

In line three delete the word “their” and replace with the words “The tellers” and continue with the remainder of the Rule.

The proposed amended Rule 25 would then read:

Conference shall nominate five tellers for approval on the opening day of Conference. The tellers duty shall be to ascertain and report to the President the number voting for and against a motion on which a poll is taken and they shall assist the President and Conference Arrangements Committee to ensure that a quorum is present”.

RULE 26 –CONFERENCE ARRANGEMENTS COMMITTEE

Addendum

In line three after the word “the Conference” delete the full stop and insert the words “and for the counting of votes for the election of the Standing Orders Committee”.

Proposed amended Rule will then read:

The Conference Arrangements Committee shall be appointed by the Central Executive Committee and shall be responsible for the preparation of the Conference and for the counting of votes for the election of the Standing Orders Committee”.

RULE 27 – STANDING ORDERS COMMITTEE

Amendment

In line three after the word “substitutes” insert the words “who shall replace any member thereof no longer a delegate,” and continue.

The first paragraph of the proposed amended Rule 27 would read:

“The Annual Delegate Conference shall elect each year a Standing Orders Committee of five delegates and two substitutes who shall replace any members thereof no longer a delegate, who shall be the Standing Orders Committee for the next following Annual Delegate Conference or for any Special Delegate Conference prior to the next Annual Delegate Conference”.

Addendum – Rule 27

Add the following as sub section (d) at the end of Rule 27

(d) The Standing Orders Committee shall be responsible for counting of all votes cast in the election of President, Vice President, Treasurer and Trustees”.

RULE 42 –DIVISIONAL COMMITTEES

Amendment

In line two after the words “there shall be” delete the word “thirty” and replace with the words “thirty one” and continue with the remainder of the rule.

In line eleven (par 2) after the word “Waterford” delete the word “Kilkenny” and continue

In line thirteen (par 2) after the words “ Division No. 13 delete the word “Carlow” and continue

At the end of the Rule insert the words “Division No. 31 Kilkenny/Carlow”.

The beginning of the proposed amended Rule 42 would read:

“For the purpose of returning representatives to the Divisional Committee there shall be thirty one electoral Divisions as follows:

Line 11 would then read - Division No. 11 Waterford

Line 13 would then read - Division No. 13 Kildare

The last line of the Rule would read - Division No. 31 Kilkenny/Carlow”

RULE 47 D

Addendum

At the end of the section (d) delete the full stop and insert the words “including the election of President, Vice President at Annual Delegate Conference”.

Proposed amended Rule 47 (d) would then read:

All vacancies on Committees shall be filled by co-option. Where vacancies exist, following on the holding of elections, co-option(s) to District/Divisional Committee(s) shall take place only after all elected position(s) have been filled including the election of President, Vice President at Annual Delegate Conference.

RULE 51A – PROCEDURE AT MEETINGS OF CENTRAL EXECUTIVE COMMITTEE

Amendment

At line three of sub section (a) after the word “exceeding” delete the words “300 members” and replace with the words “the number derived by dividing the agreed Garda strength by a factor of the total number of Central Executive Committee representatives plus one” and continue with the remainder of the rule.

Proposed Amended Rule 51 (a) would then read:

Members of the Central Executive Committee representing Divisions of the Association comprising up to but not exceeding the number derived by dividing the agreed Garda strength by the total number of Central Executive Committee representatives plus one shall be entitled to cast one vote on the question under consideration”.

AMENDMENT RULE 51B

At line two of sub section (b) after the word “over” delete the words “300 members” and replace with the words “the number derived by dividing the agreed Garda strength by a factor of the total number of Central Executive Committee representatives plus one” and continue with the remainder of the rule.

Proposed amended Rule 51(b) would then read:

Members representing Divisions of the Association comprising over the number derived by dividing the agreed Garda strength by the total number of CEC representatives plus one shall be entitled to cast two votes on the question under consideration.Central Executive Committee

57. PRESIDENT

Amendment 1

In line five after the word “elected” insert a full stop. Delete the remainder of the rule and replace with the following:

“The President shall be eligible to present for re-election. In the event of the President not seeking re-election or in the event that he is not re-elected he shall vacate the office at the close of the second Annual Delegate Conference”.

Proposed Rule 57 will read as follows:

There shall be a President of the Association who shall be elected by a single transferable vote at the Annual Delegate Conference and shall hold office for two years. The President shall enter upon that office at the close of the Annual Delegate Conference at which he is elected. The President shall be eligible to present for re-election. In the event of the President not seeking re-election or in the event that he is not re-elected he shall vacate the office at the close of the second Annual Delegate Conference.

Amendment 2

In line five after the word “elected” insert a full stop. Delete the remainder of the rule and replace with the following:-

“The President shall be eligible to present for re-election for one extra term. In the event of the President not seeking re-election or in the event that he is not re-elected he shall vacate the office at the close of the second Annual Delegate Conference”.

Proposed Amended Rule 57 will read as follows:

There shall be a President of the Association who shall be elected by a single transferable vote at the Annual Delegate Conference and shall hold office for two years. The President shall enter upon that office at the close of the Annual Delegate Conference at which he is elected. The President shall be eligible to present for re-election for one extra term. In the event of the President not seeking re-election or in the event that he is not re-elected he shall vacate the office at the close of the second Annual Delegate Conference.

60. VICE PRESIDENT

Amendment

In line five after the word “elected” insert a full stop. Delete the words “and shall vacate that office at the close of the second Annual Delegate Conference after his election. The Vice President shall not be eligible for ensuing re-election to that office” and replace with the following and continue with the remainder of the rule:-

“The Vice President shall be eligible to present for re-election. In the event of the Vice President not seeking re-election or in the event that he is not re-elected he shall vacate the office at the close of the second Annual Delegate Conference”.

Amended Rule 60 would then read:

There shall be a Vice President of the Association who shall be elected by a single transferable vote at the Annual Delegate Conference and shall hold office for two years. The Vice-President shall enter upon that office at the close of the Annual Delegate Conference at which he is elected. The Vice President shall be eligible to present for re-election. In the event of the Vice President not seeking re-election or in the event that he is not re-elected he shall vacate the office at the close of the second Annual Delegate Conference. The Vice President shall act for the President in his absence or when requested to do so by the President”.

RULE 67 A TREASURER

In line two after the words “be elected” insert the words “every four years” and continue with the remainder of the Rule.

The proposed amended Rule 67(a) would then read:

There should be a Treasurer of the Association who shall be elected every four years by the Annual Delegate Conference and shall be eligible for re-election once and only once to that office.

RULE 73 B GENERAL SECRETARY

After the word “appointed” insert the words “or re-appointed”. After each occurrence of the word “appointment” insert the words “or reappointment”.

Proposed amended Rule would then read:

The General Secretary shall be appointed or reappointed by the Central Executive Committee and such appointment or re-appointment and conditions attaching thereto shall be ratified by the next annual or special delegate conference following the appointment or reappointment.

RULE 73C GENERAL SECRETARY

In line four after the word “Committee” insert the words “Said contractual agreement shall be for no more than four years, renewable at Conference” and continue with the remainder of the Rule.

“That the General Secretary shall be employed on a full time basis under contractual agreement and shall fulfil such duties as are assigned to him by the Central Executive Committee. Said contractual agreement shall be for no more than four years, renewable at Conference”.

RULE 74 B DEPUTY GENERAL SECRETARY

In line two after the words “contractual agreement” insert the words “Said contractual agreement shall be for no more than four years, renewable at Conference” and continue with the remainder of the Rule.

Proposed amended Rule would then read:

The post of Deputy General Secretary will be filled on a full-time basis under contractual agreement. Said contractual agreement shall be for no more than four years, renewable at Conference.

Rule 75 Selection and Appointment of General Secretary and Deputy General Secretary

Amendment

In the title of the Rule after the words “General Secretary” delete the word “and” and replace with a comma and continue. At the end of Rule title insert the words and “Assistant to the General Secretary”.

In line two after the words “Deputy General Secretary” insert the words “or in the office of the Assistant to the General Secretary” and continue with the remainder of the Rule.

Proposed amended new Rule title would read Rule 75 would read:

Selection and Appointment of General Secretary, Deputy General Secretary and Assistant to the General Secretary

The first sentence of the Rule would then read:

Where a vacancy arises in the Office of General Secretary or in the Office of Deputy General Secretary or in the Office of Assistant to the General Secretary, the Central Executive Committee shall cause an interview board to be established, comprising members of the Central Executive Committee and a person or persons nominated by such outside bodies as may be designated by the Central Executive Committee and then continue with the remainder of the Rule.

In line two after the words “contractual agreement” insert the words “Said contractual agreement shall be for no more than four years, renewal at Conference and continue.

The post of Assistant to the General Secretary will be filled on a fulltime basis under contractual agreement. Said contractual agreement shall be for no more than four years, renewable at Conference.
